Statement by the VCP regarding the projected Anti-blockade law

The Communist Party of Venezuela made a statement last 5th of October about the projected Anti-blockade law that president of the Republic, Nicolas Maduro, presented at the Constituent National Assembly. (Now approved).

¨In a live transmission, the General Secretary of the VCP, Oscar Figuera warned: We must state that (being responsible before our country) the projected Anti-blockade law, far from representing a protective action to protect the interests of the fatherland (…) constitutes a serious setback. This will deepen the economic vulnerabilities of the country before their external aggresors. At the same time it will put the weight of the crisis and sanctions on the shoulders of the workers and the general population

Through this current statement, the Central Committee of the Venezuelan Communist Party (PCV, acronyms in Spanish) lets the workers, the media and public opinion in general, of the country know its position about the law proposal presented before the Constituent National Assembly by the president of the Republic Nicolas Maduro Moros, entitled “Constitutional Anti-blockade Law for the National Development and Guarantee of Human Rights”.

Firstly, the Venezuelan Communist Party (PCV) reiterates that it is absurd to deny the objective existence of a growing political, diplomatic, economic and military agression from American imperialism and their European allies, against the sovereignty of the country. The imposition of unilateral, coersive and illegal blockade, has an evident deterioration impact on the national economic activity. The ones most affected by these interventionist policies are the working people of the city and the contryside.

As we have always expressed, this foreign aggression against our right to self-determination and sovereignty must be object of the strongest of condemnation by our people. As, also, the accomplice and servile actions of those economic and political sectors who have submitted themselves to request, promote, and justify the application of these criminal measures against the country and working people. From the PCV we continue to demand from the Venezuelan State that impunity stops and that politicians (who serve as puppets to imperialist plans against our country) are punished with the full weight of the law.

From this perspective, we reiterate our position of the need to confront these agressions (the blockade and imperialist sanctions) through a coherent political action in defense of sovereignty and the development of productive capabilities of the country. In this sense, we have expressed that the defeat of the imperialist intervention goes through (necessarily) by building a revolutionary alternative for the crisis, of a dependent and rentier capitalist Venezuela.

We must state that (being responsible before our country) the projected Anti-blockade law, far from representing a protective action to protect the interests of the fatherland, constitutes a serious setback. This will deepen the economic vulnerabilities of the country before their external aggresors. At the same time it will put the weight of the crisis and sanctions on the shoulders of the workers and the general population.

The project is not really an anti-blockade law, nor is its object to protect the national interest and the Venezuelan people, from the disastrous effects of imperialist sanctions. As we have made evident in this writing, through the national governments legal instrument, what it tries to do is justify and give its sold-out and subordinate political policies to the interests of capital, a legal appearence . The orientation of the law is refutable proof of the allegation that we have being expressing from the PCV about the continuation of an incongruent government policy that is anti-worker, not popular, and contrary to the defense of national sovereignty.

To pretend to give the mentioned law a constitutional character, a legal hierarchy that is not typified in the national Constitution ( with the object of justifying the granting of illegal powers to the national executive so as to not apply or jump any current norm or law of the legal system that might contradict the sellout intentions of your project) represents really a partial derogation of the Bolivarian Republic of Venezuelas Constitution. In this sense, we denounce this attempt to approve a law project through the National Constituent Assembly as an inconstituonal act (the content of a project that pretends to be above the Constitution of the Bolivarian Republic of Venezezuela.)

With this action, the government aims to effectively give our oil industry to transnational capital, the devolution of lands to landowners and the return of nationalised companies to the private sector, the opening of monopolistic capital to the strategic economic sectors reserved by the Constitution by the Venezuelan State, the sale of holdings and companies to the highest bidder, offer stealth guarantees contrary to the interests of the country, or against our constitution, our laws, given to monopoly capital, ceding national sovereignty allowing that transnational companies may demand from our country in international tribunals.

Additionally, they aim to carry out this handing over and damage to the sovereign national interest, through an illegal act of confidential minutes and contracts with sectors of transnational capital that would be granted to them, by their irresponsible law proposal. From this perspective and against the interests of our people, this law would endorse the worsening of the corruption of the public administration as well as it would guarantee the greatest impunity to those who carry out harmful acts against state property.

From the Venezuelan Communist Party (PCV) we call upon the constituents to honour their pledge with the Bolivarian Republic of Venezuela and with the interests of the fatherland and the Venezuelan people, and to manifest its rejection to the approval of this anti patriotic and anti Bolivarian law. Constituent freiends, your uncritical silence and acceptance would make you complice of the most shameful handover of the Venezuelan homeland to transnational capital. We demand that you get up and put yourselves on the vanguard of the defense of the interests of the Venezuelan poeople. You can count on the Venezuelan Communist Party (PCV), with the Venezuelan Communist Youth (JCV), you can count with the revolutionary people’s forces who will be beside the constituents who might decide that step in defense of the Bolivarian homeland.

We call upon the Venezuelan people to manifest their energetic rejection against “law of surrender”. It is the responsibility of revolutionaries and patriots to join a national campaign to defend the Constitution of the Bolivarian republic of Venezuela, to denounce the content of this law and to demand that it is not approved.

In the next meeting (this week) of the national coordination of the Revolutionary People’s Alternative (APR, acronyms in Spanish), the Communist Party shall present a series of proposals and initiatives directed so that all the social and political forces that make up the APR put forward a joint position to defend sovereignty in a unified manner, to stop the violation of the Constitution of the Bolivarian republic of Venezuela and to accompany the people in the actions that must be taken in this respect.

Let us defend the Constitution of the Bolivarian Republic of Venezuela!

Imperialism is not defeated with reformist and sellout policies!

No to the privatization of the oil, gas and mineral industry!

No to the privatization of national firms!

No to the impunity of corrumpt ones!

For a revolutionary departure of the Venezuelan capitalism sellout!

SolidarioGB is in the view that any Constituent National Assembly is the “sovereign” and is entitled (under bourgeoisie norms) and has the right to change a constitution, that is why they are called to act in certain periods of history. What might be occurring here is that the executive power has other hidden intentions and they know full well that the spirit of the law will not be followed for the desired ends, which should be the argument here instead. Also, a whole assembly can be wrong as they are made up of human beings. And, if one does not have proof of intentions, one should be cautious and vigilant of the developments and how they ensue. One must also remember that Venezuela is a country on the path of Socialism and that is why it is usually termed as “Socialism of the XXI century”. This term encapsulates the fact that is not YET a socialist country. Just like Cuba wasn’t in the first few years of their Revolution.

Here, we must remember what Karl Marx, Frederick Engles, Lenin, and Jawitsch said about the Law and who usually controls it. Thus Marx said:

“Law, morality, religion, are to [the proletariat] so many bourgeois prejudices, behind which lurk in ambush just as many bourgeois interests.”

And lenin added later:

“The State is an organ of class domination, an organ of oppression of one class by another; its aim is the creation of ‘order’ which legalizes and perpetuates this oppression by moderating the collisions between the classes.”

Jawitsch also said:

“Complete success in the masses’ struggle for their democratic rights and liberties can only be achieved by overcoming monopoly capital’s economic and political domination and establishing a state authority that expresses the interests of the working people.”

Lastly, in respect to Marxist legal theory, Lenin stated:

“The revolutionary dictatorship of the proletariat is won and maintained by the use of violence by the proletariat against the bourgeoisie, rule that is unrestricted by any laws.”
